We submitted a single real-world transaction scenario to the same AI model twice, using slightly different prompts. The results were not merely different — they were contradictory. And both were persuasive.

Export activity has historically been sporadic, tied to infrastructure projects rather than continuous trade flows. The owner is publicly regarded as reputable, with recent media coverage referencing new commercial engagements in South Africa.

The transaction triggered four monitoring alerts:

  • No prior transaction history with this counterparty

The same AI model was then asked to assess this transaction twice — with slightly different prompts.

Two Verdicts. One Transaction.

🔴 True Positive — "Escalate immediately."

The USD 10M payment exceeds the client's entire declared annual revenue. It originates from a first-time counterparty, is routed through a third-country correspondent bank introducing an unnecessary layering step, and settles in three days — inconsistent with standard trade finance norms for a contract of this magnitude. Supporting documentation alone cannot mitigate these red flags. This presents a classic trade-based money laundering typology. Escalate for enhanced due diligence and potential regulatory disclosure.

🟢 False Positive — "Close the case."

The USD 10M value, while above last year's revenue, is consistent with the client's known pattern of large, episodic export contracts tied to infrastructure projects. Documentation is complete. The South African counterparty and correspondent routing are corroborated by recent media coverage of the client's new market engagements. No adverse media, sanctions, or PEP indicators exist. Alerts were triggered by automated thresholds — not substantive financial crime risk.

Same transaction. Same AI model. Different prompt. Opposite conclusions.

The subtle difference between the two responses comes down to the weight assigned to the same facts. In the first, the revenue gap and routing are framed as red flags. In the second, the same facts are contextualised as normal for an episodic exporter. The AI does not change the facts. It changes the interpretation — and does so confidently, whichever direction it is pointed.

"AI will apologise and change its answer. Does your regulator accept answers when you apologise?"

The Accountability Gap No One Is Talking About

This is not a failure of AI capability. It is a failure of AI governance — and the distinction matters enormously. The problem is not that institutions are using AI. The problem is that many are using it without structures that preserve human accountability at the point of consequential decision-making.

What AI can do: Synthesise large volumes of case information quickly. Surface patterns across transaction history. Draft SAR narratives and compliance memos. Accelerate investigator workflows.

What only humans can do: Own the decision. Appear before a regulatory panel. Exercise professional judgement across ambiguous facts. Sign the SAR. Bear responsibility for the outcome.

When a compliance officer files — or decides not to file — a suspicious activity report, they own that decision. No AI model will sit in that examination meeting. No algorithm will be named in an enforcement action. The accountability remains with your institution, and with your people.

What Sensible AI Adoption Actually Looks Like

Sensible adoption does not mean avoiding AI. It means building the governance, skills, and frameworks that allow AI to make your analysts faster and more effective — without ever substituting for their judgement on consequential decisions.

1. Appoint AI literacy at the leadership level Every compliance division should have a designated AI advisor — internal or external — who understands both the capabilities and the failure modes of the tools being used.

2. Treat AI outputs as drafts, not decisions AI-generated case narratives, risk assessments, and recommendations must pass through analyst review before any action is taken. The analyst's sign-off is not a formality — it is where accountability resides.

3. Understand prompt sensitivity as a risk factor If your AI model produces materially different compliance verdicts based on minor prompt variations, that variability is a risk exposure, not an AI quirk. Document how AI tools are being prompted and by whom.

4. Invest in AI skills across the compliance team Analysts who understand how AI reasons — and where it fails — are far better positioned to use it effectively and to catch errors before they become regulatory problems.

5. Keep AI behind your analysts, not in front of them AI should assist your analysts, accelerate their workflows, and reduce administrative burden. It should not be positioned as the decision-maker, even implicitly.
